Dear Mr Frame,
Thank you for your letter dated 6th April 2000 concerning an education campaign about the age of consent. The Honourable Matt Foley MLA, Attorney General and Minister for Justice and Minister for the Arts, has asked me to reply to you on his behalf.
The offence of unlawful sodomy applies to any person who sodomises a person under 18 years, or permits a male person under 18 years to sodomise him or her.
Since 1990, when the Goss Labor Government first decriminalised anal intercourse between consenting adults, the age of consent has remained at 18.
You are correct in noting that for other forms of sexual activity, the age of consent for both males and females is 16 years.
While there may be confusion in some quarters about the differing ages of consent this Department does not propose to engage in an education campaign.
